Every year around Memorial Day, the Montgomery County District Attorney’s Office kicks off its “Operation Blackout” campaign ahead of what many term the “100 deadliest days of Summer.” The campaign, which runs through the Labor Day Weekend includes increasing No Refusal weekends and DWI and boating while intoxicated (BWI) arrests. This effort coincides with heaver traffic on Lake Conroe and the surrounding roadways in Montgomery County.

During this time, you need to be aware of the impact of No Refusal efforts by law enforcement. If you are arrested for DWI or BWI, the officer will request a breath or blood sample. If you refuse, the officer will contact a prosecutor who drafts a search warrant for your blood. That warrant is sent to a judge who is on-call. The judge reviews the warrant for probably cause. If the judge finds probably cause, your blood will be taken by a nurse.
