We begin by reviewing the arrest details and available evidence, explaining your rights and legal options, and identifying issues that need immediate attention.

Preparation Designed to Keep Critical Details in View

Our broader criminal defense practice draws on more than four decades of legal experience and more than 1,000 cases handled. We apply that experience through an organized preparation model rather than relying on assumptions about what happened.

We emphasize continuous attorney education and use checklists designed to reduce the risk of missing case details. We also work efficiently so evidence, court obligations, and defense decisions receive prompt attention while you remain informed about your options.

I highly recommend Gary Trichter to represent you or your loved one.

What Aggravated Assault Means Under Texas Law

Texas Penal Code Section 22.02 generally applies when a person commits an assault defined by Section 22.01 and either causes serious bodily injury or uses or exhibits a deadly weapon during the assault. Section 22.01 includes causing bodily injury, threatening someone with imminent bodily injury, and certain offensive or provocative physical contact.

The two primary aggravating factors are:

  • Serious bodily injury: An injury involving death, a substantial risk of death, serious permanent disfigurement, or protracted loss or impairment of a body part or organ.
  • Use or exhibition of a deadly weapon: An allegation involving a firearm or another object designed, adapted, or used in a way capable of causing death or serious bodily injury.

Whether an object qualifies as a deadly weapon can depend on what it was and how it was allegedly used or displayed. Physical contact isn’t always required if the state alleges that someone threatened imminent injury while using or exhibiting a deadly weapon.

Second-Degree & First-Degree Felony Penalties

The offense is generally charged as a second-degree felony in Texas. The ordinary punishment range is two to 20 years in prison and a fine of up to $10,000.

Certain circumstances can elevate the charge to a first-degree felony. These include specified family-violence injuries involving a deadly weapon, assaults against certain public servants or protected individuals, qualifying firearm conduct involving a vehicle, and allegations that meet the statute’s mass-shooting provisions. The ordinary punishment range for a first-degree felony is five to 99 years or life in prison, plus a fine of up to $10,000.

The applicable classification and punishment depend on the charged facts, statutory enhancements, criminal history, and case outcome. We review those factors before advising you about your potential exposure.

What to Do After an Arrest or Accusation

Protect the integrity of your defense while complying with lawful instructions, bond conditions, and court appearance requirements. Don’t discuss the incident with investigators or post about it online before receiving legal advice.

Useful steps for an initial case review include:

  • Preserve documents: Keep arrest paperwork, court notices, bond conditions, medical records, photographs, and relevant messages.
  • Save potential evidence: Retain videos, digital communications, location information, and other materials connected to the incident.
  • Prepare a timeline: Record events, locations, witness names, and important details while they remain fresh.
  • Avoid direct contact: Don’t contact an alleged victim or witness in a way that could violate a court order or create another legal issue.

The legal effect of each step depends on the facts and any existing court orders. We can assess your situation before you make decisions about statements, investigators, evidence, or court obligations.
