Consequences of a DWI conviction for CDL holders

  • If you are successful in avoiding the suspension of your license through the ALR process, your license could still be suspended with the criminal case. 
  • A guilty plea of any kind to a DWI will result in the cancellation/revocation of your CDL for 1-year, even if your driver’s license is not ordered suspended by the Court.  
  • In many counties it is possible to resolve these cases without a guilty plea and avoid those consequences through Pre-Trial intervention programs or alternative plea bargain resolutions.

Steps to Protect Your CDL

  • The law treats regular license holders very different than CDL holders. The consequences for a CDL holder are much more harsh than that of an ordinary license holder.  
  • CDL defendants will suffer a drivers license suspension where a BAC is .04 or more if arrested in their commercial vehicle.  That is not the case for regular license holders where the legal limit is .08 for a non-CDL holder. If a CDL holder is arrested in their personal vehicle the limit is .08.  
  • Immediately retain counsel to ensure that an ALR is requested within the required timeframe to avoid suspension
