Houston Drug DWI Defense Attorney
More Than 45 Years of Focused DWI Defense Across Texas
A Drug DWI allegation can involve prescription medications, marijuana or THC, controlled substances, over-the-counter drugs, or a combination of substances. Alcohol doesn’t need to be involved for the State to allege intoxication.
Our Houston-based firm pairs aggressive criminal defense with caring, understanding counsel. Drawing on more than 45 years of DWI experience, we represent clients in Houston and across Texas. Our attorneys use detailed checklists to identify issues that might otherwise be missed, pursue continuous education, and work efficiently on both the criminal and driver-license proceedings.

How We Review the Evidence in a Houston Drug DWI Case
Under Texas law, prosecutors may allege that a drug, controlled substance, dangerous drug, combination of substances, or another substance caused the loss of normal mental or physical faculties. Whether the evidence proves that allegation requires an individualized review.
Detection and impairment are separate issues. A blood sample may show that a substance was present without establishing when it was consumed, how it affected the person, or whether it impaired driving. Likewise, a valid prescription doesn’t automatically prove or disprove intoxication.
Our review considers questions such as:
- Reason for the stop: What driving conduct did the officer observe, and was there a lawful basis for the detention?
- Signs of impairment: Did the officer’s observations correspond with the substance allegedly involved?
- Testing timeline: How much time passed between the driving, arrest, blood collection, and laboratory analysis?
- Alternative explanations: Could a medical condition, fatigue, stress, or another circumstance account for the reported observations?

How Texas Defines Drug-Related Intoxication
Texas Penal Code Section 49.04 prohibits operating a motor vehicle in a public place while intoxicated. Section 49.01 defines intoxication to include the loss of normal mental or physical faculties because of drugs, controlled substances, dangerous drugs, combinations of substances, or other substances.
Unlike the standard for alcohol concentration, Texas law doesn’t set a single numerical threshold that defines impairment for every drug. The analysis may instead focus on the person’s faculties at the time of driving and whether the evidence connects the substance to observed impairment. Although some people call the allegation Drug DUI, Texas generally uses DWI terminology.
What Evidence Can Shape a Drug DWI Case?
These cases may draw on several forms of evidence, but no single category tells the whole story. We examine whether the officer’s observations, testing procedures, toxicology findings, and timeline support one another.
Common evidence requiring close review includes:
- Officer observations: Driving conduct, speech, balance, coordination, alertness, and statements recorded during the investigation.
- Field sobriety tests: The instructions, administration, conditions, scoring, and recorded performance during roadside testing.
- Drug Recognition Expert evaluation: A structured officer evaluation intended to identify possible drug-related impairment and classify the suspected drug category.
- Blood toxicology testing: The collection, storage, handling, analytical method, reported substance, concentration, and timing of the sample.
- Medical information: Prescription records, dosage instructions, health conditions, and other information relevant to the reported symptoms.
A toxicology test may identify a drug or metabolite, a substance produced as the body processes a drug. The finding’s significance can depend on the substance, laboratory method, sample timing, reported concentration, and relationship to the person’s driving and behavior.

What to Preserve After a Drug DWI Arrest
Gary Trichter, our founder, was the first Texas attorney board certified in DWI defense. Our firm has handled thousands of DWI cases, and we apply that focused background to the distinct evidence in every new case.
Keep all paperwork provided by the officer, court, bond office, and Texas Department of Public Safety. Gather prescription information, medication packaging, dosage directions, and relevant medical records for our attorneys to review. Don’t assume that a prescription, a negative alcohol test, or a detected drug resolves the case by itself.
